1.Who we are

This Privacy Policy applies to Bathala Scents and Natural Wellness ("Bathala", "we", "us"), Winnipeg, Manitoba, and to our website bathalascents.ca (the "Site"). We follow Canada's federal privacy law, the Personal Information Protection and Electronic Documents Act (PIPEDA), and other privacy laws that apply to us.

2.What we collect

• Order information: name, billing and shipping address, email address, phone number and payment details (card details are handled by our payment processors, and we do not store full card numbers).
• Account and loyalty information: your name, contact details, order history and points if you create an account or join our loyalty program.
• Messages and support: what you send us by email, the contact form, in store, or through Facebook Messenger, Instagram and other social platforms.
• Device and usage information: browser type, IP address, time zone, pages and products viewed, search terms and how you use the Site, collected automatically through cookies, pixels and similar tools.
• Custom orders: sizes and preferences you give us for made-to-measure items.

3.Why we use it

We collect and use your information with your consent, or where the law allows, for these purposes:

• to take, process, ship and support your orders and take payment;
• to communicate with you about your order, questions and requests;
• to run our loyalty program and apply discounts or rewards;
• to prevent fraud and keep our Site secure;
• to understand how the Site is used and improve our products and website;
• to send you news, offers and updates, but only if you have agreed (see below);
• to meet legal, tax and accounting obligations.

4.Marketing emails and messages

We send promotional emails or messages only with your consent, in line with Canada's Anti-Spam Legislation (CASL). Every message will say who we are and how to contact us, and includes a way to unsubscribe. You can withdraw consent at any time by using the unsubscribe link or emailing info@bathalascents.ca. We will still send you essential messages about your orders.

5.Who we share it with

We do not sell your personal information. We share it only with service providers and partners who help us run Bathala, and only as needed:

• Shopify (our online store platform and payment processing);
• Shipping and delivery companies, so your order can reach you;
• Google (Google Analytics and Google and YouTube sales channels) for site analytics and search listings;
• Meta (Facebook, Instagram and Messenger), TikTok and Pinterest, for our shops and advertising on those platforms, and when you contact us there;
• Translation, loyalty, pre-order and similar apps that we use on the Site;
• Professional advisers, such as accountants and lawyers, and authorities where the law requires it, or to protect our rights.

Each provider has its own privacy practices, and we ask that they protect your information.

6.Cookies and advertising

Cookies are small files stored on your device. We use them to keep your cart working, remember your preferences, measure how the Site is used and, with your consent where required, to show relevant ads. Some of our partners, such as Google, Meta, TikTok and Pinterest, may use cookies and pixels to measure and personalize advertising.

You can control cookies in your browser settings (blocking some may stop parts of the Site working) and opt out of targeted advertising here:

Because there is no consistent industry standard, we do not change how we collect data when we receive a "Do Not Track" signal.

7.Where your information is stored

Our service providers, including Shopify, may store and process your information in Canada, the United States, Ireland and other countries. When your information is stored outside Canada, it may be accessed by courts, law enforcement and other authorities in those countries under their laws.

8.How long we keep it and how we protect it

We keep personal information only as long as we need it for the purposes above, and as long as tax, accounting and business-record laws require. When we no longer need it, we delete or anonymize it. We use reasonable safeguards, such as secure checkout, access controls and trusted providers, to protect your information, but no system is completely secure.

If a breach of security safeguards creates a real risk of significant harm to you, we will notify you and the Privacy Commissioner of Canada as the law requires.

9.Your choices and rights

You may at any time:

• ask to see the personal information we hold about you;
• ask us to correct it or delete it, where the law allows;
• withdraw your consent to marketing or other uses (this may limit some services);
• ask a question or make a complaint about how we handle your information.

Contact us at info@bathalascents.ca. We may need to confirm your identity first, and we will reply within the time required by law. If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada at priv.gc.ca.

Residents of the EEA, the UK or California may have additional rights, such as access, portability, correction and erasure. Contact us to exercise them. We do not sell personal information, and we do not make decisions based solely on automated processing that significantly affect you (Shopify uses limited fraud screening, such as temporarily blocking IP addresses or cards linked to repeated failed payments).

10.Children

Our website is not directed at children under 13, and we do not knowingly collect their personal information. If you believe a child has given us information, contact us and we will delete it.

11.Links to other sites

Our Site links to other websites and social platforms. We do not control their privacy practices, so please read their policies.

12.Changes to this policy

We may update this policy from time to time to reflect changes to our practices, tools or the law. The latest version, with its "last updated" date, is always on this page.
